Promoter: St Austell Brewery Company Ltd, 63 Trevarthian Road, St. Austell, Cornwall, PL25 4BY.

1.   This Promotion is open to customers of the Promoter (“Premise Customer/s”), acting through an employee with authority to make purchases who must be 18 or over. Employees of the Promoter and employees of participating wholesalers along with their immediate family members are not permitted to participate.

 

2.   Maximum one entry per person for the headline draw.  Maximum one prize per household.

 

3.   Main Promotion Period: 00:01 on 1st January 2025 until 23:59 on 28th February 2025. There is one prize draw at the end of the promotional period.

 

4.   To participate:

 

 

a.                    St Austell Brewery Business Partner customers must access the entry form online at www.staustellbrewery.co.uk/run-a-pub/win-with-buy-5-get-one-free and complete with their full name, email and date of birth.

5.   Prizes:

Main Prize:

1 winners will each win two tickets to Exeter Chiefs,

·       1 winners will each win a  Hot Air Balloon Ride and a Nights Stay in Somerset

·       1 x winners will receive a hospitality Experience for Liverpool FC in 2025

·        

Hot Air Balloon ride for two people includes an overnight stay with breakfast at Cadbury House Hotel. Winner will need to contact First Flight Balloon operator to book their flight. Subject to availability and weather constraints. Flight must be redeemed by 31st December 2025.

·       Hospitality Experience at Liverpool FC in 2025 is for two people hosted in the Carlsberg Suite, with the opportunity to meet Liverpool legends. The prize also includes an overnight stay (double room) at the Liverpool Hotel with breakfast included.

 

6.     Prizes are not transferrable and cannot be exchanged for cash. In the event of unforeseen circumstances, the Promoter reserves the right to substitute a prize, or part of a prize, for an alternative of equal or greater value.

 

7.     It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of their prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

9.     Licensee retains the right to withdraw or amend promotion without prior notice. Collector card value £0.001p. Promotion only available to persons aged 18 or over. Drinks do not have to be purchased in one single session.

 

10.  Prize Draw winner selection and notification: All valid entries received by the Promoter during the relevant Periodic Draw Period and during the Main Draw Period will be submitted into a prize draw to be conducted by or under the supervision of an independent body within 5 working days of the end of the Promotion Period.  The Draw Prize winners and 5 reserves will be selected, for each Periodic Draw.  One winner and two reserves will be selected for each Headline Prize. The provisional winners will be notified by email to the account associated with the relevant winning entry within 5 working days of date of the winner selection. The winners must respond within 10 working days of the date of the notification email, confirming compliance with these Terms and Conditions and eligibility (name, age, venue details). Failure to comply with this timeframe may result in disqualification of that winner and that Prize being awarded to a reserve selected in the same manner as described above. Entrants are encouraged to monitor their email account during this time in case they are a Prize Draw Prize winner. 

 

11.  Unclaimed Prize Draw Prize(s): If despite the best efforts of the Promoter, a Prize Draw Prize remains unclaimed after offering to 2 reserves, the Promoter shall not be obliged to allocate that Prize but may withdraw it from the promotion. 

 

12.  Further Prize details:

a.         All voucher prizes will be supplied within 30 days of winner verification. 

b.         Once a prize has been provided the Promoter shall be liable for any failure to comply with its obligations caused by (but not limited to) weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, or any other circumstances beyond the control of the Promoter or travel companies.

 

13.  Privacy: Subject to clause 19 below, the details you provide when entering this promotion, namely your email address, will be held by the Promoter under the terms of its privacy policy, available here.  Your personal data will be used by the Promoter and its agents acting on their behalf only for the operation of this promotion. If you are a winner we may supply your personal details to our third party fulfilment provider in order that they can deliver the prize. The Promoter is bound by the EU General Data Protection Regulation (GDPR) and the UK Data Protection Act 2018 and all applicable laws. Your personal data will be stored for 3 months from the end of the Main Promotion Period, after which it will be deleted. Your personal data will not be used to marketing purposes. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to privacy@staustellbrewery.co.uk. By participating in the Promotion, you agree to the use of your personal data as described here.

 

14.  Winner details: The surnames and counties of residence of the Main Prize winners can be obtained by [contacting your wholesaler/ St Austell Brewery Representative/ emailing info@staustellbrewery.co.uk with “St Austell L&T Pint Redemption Winners” in the header to arrive] between 1 January and 31 December 2025. Entrants and winners can object to disclosure, or request that disclosure be limited in scope by including this in their response to their win notification. In any case, if a regulatory body requests confirmation of the existence of winners, or evidence of receipt of prizes, the Promoter shall be entitled to disclose the information of any winner to the regulatory body only.

 

15.  The Promoter reserves the right to verify any claimant, including their age (via means of photographic identification), before awarding a Prize and refuse to award the Prize or withdraw Prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion. If it becomes apparent that an entrant is hiding their identity by using multiple email accounts, manipulating IP addresses, using identities other than their own or any automated means in order to increase that entrant’s entries, the Promoter reserves the right to cancel any prize claimed by that entrant in breach of these terms and conditions.

 

16.  Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted.  If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the draw in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.

 

17.  Incomplete, illegal, misdirected or invalid entries, or entries not in accordance with these Terms and Conditions will not be accepted.  Proof of sending will not be accepted as proof of delivery. 

 

18.  No responsibility can be taken for entries which are late, lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to the entry site. Entries not in accordance with these terms and conditions will not be accepted.  Proof of sending will not be accepted as proof of delivery.  The Promoter is not liable for any non-delivery of prizes caused by the provision of wrong information by any winner. 

 

19.  Insofar as permitted by law, the Promoters, its agents, and distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury or death occurring as a result of entering or taking up the Prize. Nothing in this clause shall limit the Promoter’s liability in respect of death or personal injury arising out of its own negligence or its fraud.

 

20.  If for any reason the Promotion is not capable of running as planned for reasons beyond the control of the Promoter (including but not limited to tampering, unauthorised intervention, fraud, technical failures) which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the running of the Promotion or to cancel, amend, terminate or temporarily suspend this promotion, with no liability to entrants or third parties.

 

21.  If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing an affected obligation. In exceptional circumstances including those described here, the Promoter reserves the right to cancel, amend, terminate or temporarily suspend thisPromotion. 

 

22.  If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

 

23.  The Promoter’s decision is final with regard to all promotional matters and no correspondence will be entered into.

 

24.  These terms and conditions are governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English and Welsh courts unless you live in another part of the United Kingdom, in which case your local courts will have jurisdiction.
